1. User License (“EULA”)
All Klin software is provided subject to license restrictions. The End User License Agreement (“EULA”) is part of the Terms of Use and governs the use of Klin software, unless subject to a separate agreement between you and Klin or its subsidiaries. In addition to the EULA or any other separate agreement, the software is subject to the following software license information, including Additional License Authorizations (ALAs) and open-source and third-party license terms.
2. License Grant
If you comply with these Terms of Use, we grant you a non-exclusive and non-transferable license to use one copy of the applicable version or release of the Software solely for your personal use or for use within your organization.
Restrictions
- You may not use the Software to provide services to third parties.
- You may not copy, distribute, resell, or sublicense the Software to others.
- These Terms of Use do not transfer any intellectual property rights.
3. Limitation of Liability
Klin's liability to you under this Agreement is limited to the amount you paid to Klin for your subscription to the applicable Software for the current calendar month, or the remaining balance of any prepaid monthly subscription fees for multiple calendar months.
4. Usage Warranties
We warrant that the Software will perform substantially in accordance with the provided documentation. This warranty is your exclusive remedy and is provided in lieu of all other warranties, express or implied. The user assumes all risks associated with the use, results, and performance of the software programs.
